Distance Sales Agreement

This agreement has been prepared in accordance with the Regulation on Distance Contracts published in the Official Gazette dated 27.11.2014 and numbered 29188, due to the legal requirement for contracts to be concluded for sales made over the internet. The articles are as follows:

ARTICLE 1 – SUBJECT
The subject of this agreement is to determine the rights and obligations of the parties in accordance with the provisions of the Law No. 4077 on the Protection of Consumers and the Regulation on the Procedures and Principles of Distance Contracts, regarding the sale and delivery of the product specified below, whose characteristics and sale price are indicated.

ARTICLE 4 – PRODUCT INFORMATION SUBJECT TO THE AGREEMENT
The type, quantity, brand/model, color, unit, sale price, payment method, and the details at the time of order confirmation of the goods/product/service are included.

ARTICLE 5 – GENERAL TERMS
5.1– The consumer declares that they have read and are informed of all preliminary information regarding the basic characteristics, sale price, payment method, and delivery of the product(s) stated in Article 4, and that they have provided the necessary confirmation electronically.

5.2– The product(s) subject to this agreement shall be delivered to the consumer or the person/institution at the address specified by them within the period stated in the preliminary information, not exceeding the legal period of 30 days, depending on the distance to the consumer’s location. This period may be extended up to 10 additional days, provided the consumer is notified in advance.

5.3– If the product is to be delivered to a person or institution other than the consumer, Ore Lecciana shall not be held responsible if that person or institution refuses the delivery.

5.4– Ore Lecciana is responsible for delivering the product intact, complete, and in accordance with the specifications in the order, along with any warranty documents and user manuals, if applicable.

5.5– The delivery of the product is contingent upon the signed copy of this agreement reaching Ore Lecciana and payment being made via the method selected by the consumer. If the product price is not paid or is cancelled in the bank records for any reason, Ore Lecciana is deemed to be released from the obligation to deliver the product.

5.6– In the event that the product is delivered but the consumer’s credit card is used by unauthorized persons unlawfully and without the consumer’s fault, and the relevant bank or financial institution does not pay the product amount to Ore Lecciana, the consumer is obligated to return the product within 3 days, provided that the product has already been delivered. In such cases, the shipping cost shall be borne by the consumer.

5.7– If Ore Lecciana is unable to deliver the product within the prescribed time due to force majeure, adverse weather conditions, or transportation disruptions, Ore Lecciana is obliged to notify the consumer. In such cases, the consumer may choose to cancel the order, request a replacement with an equivalent product, or postpone the delivery until the obstacle is resolved. If the consumer cancels the order, the amount paid shall be refunded in full within 15 business days.

5.8– Products with or without a warranty certificate that are defective or malfunctioning may be sent to Ore Lecciana for repair under warranty conditions. In such cases, shipping costs will be covered by Ore Lecciana.

5.9– This agreement becomes effective once it is signed by the consumer and received via fax or post, or upon the consumer’s electronic approval on the website.

5.10– Product prices displayed on the Ore Lecciana website include VAT but exclude shipping fees. Promotional campaigns are subject to the terms and conditions specified and may be changed at any time.

ARTICLE 6 – RIGHT OF WITHDRAWAL
The consumer has the right to withdraw from the agreement within 14 days from the delivery of the product to them or to the designated recipient. To exercise the right of withdrawal, the consumer must notify Ore Lecciana via fax, email, or phone within this period, and the product must not have been used, in accordance with the relevant provisions. In the event of withdrawal, the product must be returned along with the delivery note and the original invoice. The refund will be processed within 15 business days after these documents are received. If the original invoice is not submitted, VAT and other legal deductions cannot be refunded. Return shipping costs due to withdrawal shall be borne by the sender.

Due to their nature, the right of withdrawal cannot be used for:
– Products that are not suitable for return
– Single-use items
– Copyable software and programs
– Perishable goods or items past their expiration date

To be eligible for return, the product must be unused, undamaged, and in its original unopened packaging.

In lawful returns within the scope of the right of withdrawal, Ore Lecciana shall bear the return shipping costs.

The right of withdrawal cannot be used for products that are customized or modified at the consumer’s request.

Returns are not accepted for items from the outlet category with less than 1 year shelf life.

If payment was made by credit card or similar methods, the consumer may request cancellation if the card was used unlawfully without their consent. In such cases, the card issuer shall refund the amount to the consumer within 15 business days after receiving the objection.

In case of disputes arising from this agreement, the Consumer Arbitration Committees and Consumer Courts located in Ore Lecciana’s place of residence shall have jurisdiction, up to the limits announced by the Ministry of Industry and Trade.

ARTICLE 7 – SHIPPING AND DELIVERY
Shipping:
Once your order confirmation email is sent, the products are handed over to the courier company we work with.

Delivery:
Products will be delivered to the address provided via our contracted courier company. The delivery period for Ore Lecciana to hand over the products to the shipping company is a maximum of 7 (seven) business days following the confirmation email. For regions where courier companies do not deliver directly, a phone notification will be provided.

In cases where delivery is made once a week, or there are incorrect or incomplete shipment details, or delays caused by social events or natural disasters, the delivery period may be extended. If the product is to be delivered to a person/institution other than the consumer, Ore Lecciana shall not be held responsible for any additional shipping costs due to refusal of delivery or incorrect shipping information or the consumer not being present at the delivery address.

To avoid delivery issues, please ensure that all shipping information is complete and that someone is present at the delivery address.

In case of damaged packages:
Do not accept packages that appear damaged; request a damage report from the courier. If the courier claims the package is not damaged, you have the right to open it in their presence and check that the products are intact. Again, a report should be prepared. Once the package is accepted, it is assumed that the courier has fulfilled its responsibility. If the package is refused and a report is issued, please notify our customer service as soon as possible with your copy of the report. Our team will take immediate action to resolve the issue.

ARTICLE 8 – PRIVACY POLICY
Personal information refers to any data that directly or indirectly identifies the user, such as name, date of birth, home address, mobile and landline phone numbers, and email address. This will be referred to as “Confidential Information.”
Ore Lecciana may use personal data for profiling, statistical analysis, advertising, marketing, promotional, and other communication purposes internally.
Ore Lecciana undertakes to keep all personal data strictly confidential, treat it as a trade secret, and take all necessary precautions to prevent unauthorized access, disclosure, or public exposure of any portion of this data. In the event of a breach due to attacks on the website or system despite all reasonable security measures, Ore Lecciana shall not be held liable.

Once the order is placed, the consumer is deemed to have accepted all the terms and conditions of this agreement.

We present for your information and approval the Clarification and Consent Text regarding the Protection and Processing of Personal Data.

In accordance with the provisions of the Personal Data Protection Law No. 6698 (KVKK), all information that identifies or makes you identifiable, including your sensitive personal data, shall be processed as Personal Data by Ore Lecciana in its capacity as Data Controller, within the scope outlined below. The processing of your Personal Data refers to any operation performed on such data, including but not limited to collection, recording, storage, preservation, alteration, reorganization, disclosure, transfer, acquisition, making available, classification, or prevention of use.

– Direct and indirect marketing, personalized marketing and remarketing activities,

By applying to Ore Lecciana, you have the right to:

III) Learn the purpose of processing and whether it is being used in accordance with that purpose,
IV) Know the third parties to whom your data has been transferred, domestically or internationally,
V) Request correction if your personal data has been processed incompletely or inaccurately,
VI) Request deletion or destruction of your personal data under the conditions stipulated in Article 7 of the KVKK,
VII) Request that the operations carried out under items (V) and (VI) be notified to third parties to whom the data has been transferred,
VIII) Object to any negative consequences arising from the analysis of your data exclusively through automated systems,
IX) Request compensation in the event of damages due to unlawful processing of your personal data.

Return and Exchange Policy

Return Conditions
The customer may request a return or exchange within 14 days from the date of delivery. Returns and exchanges are accepted only if the product is unused and undamaged.
